Until that point, litigators generally don’t retain experts, thinking it saves them money. In reality, it is in the client’s best interest to actually retain an expert early because they can help with other aspects of the trial in addition to their expert testimony.

We recently lost a case because it was being tried in Texas and the litigator wanted an expert from Texas because he thought that his jury would not like a New York expert.
